Regulations on the Administration of Acceptance of Foreign Students by Institutions of Higher Learning

Chapter I General Provisions
Article 1 In order to enhance understanding and friendship between China and the peoples of the world, promote international exchanges and cooperation in Institutions of higher learning, and strengthen the standardized management of the work of accepting and training foreign students, in accordance with the Education Law of the People's Republic of China, the Law of the People's Republic of China on Higher Education and the Law of the People's Republic of China outside the People's Republic of China. These Provisions are formulated in the Law on the Administration of Entry and Exit of Chinese People.
Article 2 Institutions of higher learning referred to in these Provisions refer to general institutions of higher learning that implement full-time higher education with the approval of the Ministry of Education; foreign students referred to in these Provisions refer to foreign citizens registered with foreign passports for academic education or non-academic education in Chinese institutions of higher learning.
Article 3 The work of accepting and training foreign students in Institutions of higher learning should follow the principle of "deepening reform, strengthening management, ensuring quality and developing actively and steadily".
Article 4 Institutions of higher learning accepting foreign students shall have the necessary teaching and living conditions, as well as the corresponding teaching, scientific research and management levels.
Article 5 Institutions of higher learning shall, in accepting and training foreign students, abide by the state's foreign policy and safeguard state sovereignty, security and public interests.
Chapter II Management System
Article 6 The Ministry of Education is responsible for the overall management of the work of studying abroad in China, formulating guidelines and policies for accepting foreign students, administering the "Chinese Government Scholarship" in a centralized manner, coordinating and guiding the work of accepting foreign students in various regions and schools, and evaluating the management and education quality of foreign students in various regions and schools. 。 The Ministry of Education entrusts the National Overseas Students Fund Management Committee to be responsible for the recruitment and specific management of foreign students within and outside the national plan.
Article 7 The acceptance of foreign students by institutions of higher learning shall be examined and approved by the educational administrative departments of provinces, autonomous regions and municipalities directly under the Central Government together with the foreign affairs and public security departments at the same level and submitted to the Ministry of Education for the record. Foreign students enjoying Chinese government scholarships in Institutions of higher learning shall be examined and approved by the Ministry of Education.
Article 8 The educational administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the coordinated management of the acceptance of foreign students by local institutions of higher learning. Foreign affairs, public security and other relevant departments assist the administrative departments of education and institutions of higher learning in the management of foreign students.
Article 9 Institutions of higher learning are specifically responsible for the recruitment, education, teaching and daily management of foreign students. Schools shall have school-level leaders in charge of the work of foreign students in their schools; schools shall establish a management system for foreign students in accordance with relevant regulations, and have centralized management agencies or administrators for foreign students affairs.
Chapter III Categories, Enrollment and Admission of Foreign Students
Article 10 Institutions of higher learning may provide diploma education and non-diploma education for foreign students. The categories of academic education are: junior college students, undergraduate students, master students and doctoral students; the categories of non-academic education are: refresher students and research scholars.
Article 11 Institutions of higher learning shall formulate measures for recruiting foreign students, promulgate regulations for recruiting foreign students and recruit foreign students in accordance with regulations.
Article 12 The quota of foreign students enrolled in Institutions of higher learning shall not be restricted by the quota of the national enrollment plan.
Article 13 Institutions of higher learning shall, in accordance with the relevant provisions of the State, determine and publish the charging items and standards for foreign students and charge them in Renminbi.
Article 14 The major accepted by institutions of higher learning by foreign students shall be open to the outside world. The establishment of a new degree education specialty for foreign students must be submitted to the Ministry of Education for approval.
Article 15 Foreign citizens who apply for study or further education in Chinese institutions of higher learning shall have corresponding qualifications and meet the requirements for admission, and have reliable economic guarantees and guarantors for affairs in China.
Article 16 Institutions of higher learning shall conduct entrance qualification examination, examination or examination for learners applying for admission to China. The admission criteria shall be determined by the school itself. The Chinese proficiency test should be conducted for those who use Chinese to receive academic qualifications.
Article 17 The admission of foreign students shall be decided by institutions of higher learning. Institutions of higher learning should give priority to foreign students enrolled in the national plan; they may enroll foreign students for intercollegiate exchange and at their own expense.
Article 18 Institutions of higher learning may accept foreign students who are admitted or transferred to other schools, but the consent of the original acceptance school shall be obtained in advance.
Chapter IV Scholarship System
Article 19 The Chinese Government establishes a "Chinese Government Scholarship" for foreign students to study in China.
The categories of "Chinese Government Scholarship" include undergraduate scholarship, Postgraduate Scholarship and advanced student scholarship.
The Ministry of Education shall set up other scholarships for special research or training as required.
Article 20 The Ministry of Education, in accordance with the agreements signed between the Chinese government and foreign governments and the needs of exchanges between China and foreign countries, formulates the enrollment plan for foreign students enjoying Chinese government scholarships.
Article 21 Foreign students enjoying Chinese government scholarships to study in China shall be subject to the annual evaluation of scholarship eligibility. The evaluation shall be carried out by institutions of higher learning in accordance with relevant regulations. Foreign students who fail to pass the evaluation will be suspended or disqualified from enjoying Chinese government scholarships in accordance with the regulations.
Article 22 Local people's governments and institutions of higher learning may establish scholarships for foreign students individually or jointly according to their needs. Chinese and foreign enterprises, institutions, social organizations and other social organizations and individuals may also establish scholarships for foreign students with the consent of institutions of higher learning and provincial education authorities, but without unreasonable conditions.
Chapter V Teaching Management
Article 23 Institutions of higher learning shall arrange the study of foreign students according to the unified teaching plan of the university, and carry out educational and teaching activities in accordance with the psychological and cultural characteristics of foreign students. On the premise of ensuring the quality of teaching, the compulsory and optional courses for foreign students can be adjusted appropriately.
Article 24 The general situation of Chinese and China shall be a compulsory course for foreign students with academic qualifications; political theory shall be a compulsory course for foreign students majoring in philosophy, politics and economics; and foreign students of other majors may apply for exemption.
Article 25 Chinese is the basic teaching language for colleges and universities to train foreign students. For foreign students whose Chinese proficiency can not meet the requirements of professional learning, schools should provide necessary Chinese remedial conditions.
Institutions of higher learning may offer specialized courses for foreign students to teach in other foreign languages, such as English, according to their conditions. Foreign students who use foreign languages for diploma education should write abstracts of their graduation theses in Chinese.
Article 26 Institutions of higher learning shall organize foreign students to conduct teaching practice and social practice together with Chinese students in schools in accordance with the teaching plan; however, when choosing places of practice or practice, they shall abide by relevant foreign-related regulations.
Article 27 Institutions of higher learning shall, in accordance with teaching needs, provide necessary learning conditions for foreign students. Foreign students who use other equipment and obtain other information outside the teaching plan shall apply for examination and approval by the school in accordance with relevant regulations and procedures.
Article 28 Institutions of higher learning shall administer the status of foreign students in accordance with the relevant provisions of the State. Institutions of higher learning shall report to the provincial administrative department of education for the record when they impose orders to drop out or expel foreign students from school; if the above-mentioned punishments are for foreign students enrolled in the national plan, the school shall also notify the National Overseas Studies Fund Management Committee in writing.
Article 29 Schools shall, in accordance with relevant regulations, issue diplomas (certificates of completion and completion) or realistic academic certificates for foreign students and degree certificates for foreign students who have obtained degrees. Schools can provide translation versions of the above certificates as required.
Chapter 6 Intra-school Management
Article 30 Institutions of higher learning shall educate and administer foreign students in accordance with relevant laws, regulations and regulations of the State. Schools should educate foreign students to abide by our laws, regulations and rules and disciplines, and respect our social morality and customs.
Article 31 Institutions of higher learning generally do not organize foreign students to participate in political activities, but they may organize foreign students to voluntarily participate in public welfare work and other activities.
Article 32 Institutions of higher learning shall allow and encourage foreign students to participate in sports activities organized by the student union of the university; foreign students may also voluntarily participate in celebrations held on major festivals in China; in cities or regions where foreign students are concentrated, relevant departments and schools shall organize activities for foreign students. Sports activities beneficial to physical and mental health.
With the approval of the school, foreign students can form friendship groups in the school, and carry out activities within the scope of the laws and regulations of our country, subject to the leadership and management of the school. Foreign students should apply to the competent authorities of the Chinese Government for establishing cross-school and cross-regional organizations.
Article 33 Institutions of higher learning shall respect the national customs and religious beliefs of foreign students, but shall not provide places for religious ceremonies. Missionary activities and religious gatherings are strictly prohibited in schools.
Article 34 With the approval of institutions of higher learning, foreign students may hold activities to celebrate their own important traditional festivals in designated places and areas, but they shall not object to or attack the contents of other countries or violate public morality.
Article 35 Institutions of higher learning shall provide necessary living facilities such as accommodation and board for foreign students, and establish and publish a management system for the use of such facilities in accordance with relevant provisions.
Article 36 Foreign students may not engage in employment, business or other business activities while studying at school, but they may participate in work-study activities in accordance with the provisions of the school.
Chapter VII Social Management
Article 37 The relevant administrative departments shall be responsible for the social management of foreign students. Institutions of higher learning should cooperate with relevant administrative departments to do a good job in the social management of foreign students.
Article 38 Foreign students may stay out of school, but they shall go to the public security organs in their places of residence for registration in accordance with the regulations.
Article 39 The relevant departments shall provide convenience for the normal study and social practice of foreign students, and the charging standards shall be the same as those of Chinese students.
Article 40 Foreign students who engage in publishing, association, assembly, procession, demonstration and other activities within the territory of China shall abide by the relevant laws and regulations of our country. Foreign students must abide by the Regulations on the Administration of Aliens'Religious Activities in the People's Republic of China when conducting religious activities in China.
Article 41 The entry and exit of articles carried or mailed by foreign students shall conform to the relevant administrative regulations of our country.
Chapter VIII Procedures for Entry, Exit and Residence
Article 42 Foreign students shall generally go through the formalities of study registration with their ordinary passport and "X" or "F" visas. Those who have studied in China for more than six months apply for an "X" visa to the Chinese visa authorities abroad on the basis of the "Application Form for Visa for Foreign Students to China" (JW201 or JW202), the "Notice of Admission" and the "Record of Physical Examination of Foreigners". Those who study in China for less than six months shall apply for an "X" visa on the basis of the "Visa for Foreign Students to China". The visa application form (JW201 or JW202) and the school's "admission notice" apply for the "F" visa to the Chinese visa authorities stationed abroad. Short-term overseas students who come to China in the form of groups may also apply for the "F" group visa by invitation letter and telegram from the authorized units.
Article 43 Those who come to China with a foreign diplomacy, official or special passport and a Chinese diplomatic, official or Courtesy visa shall apply to the foreign affairs departments at the provincial and ministerial levels of China on the basis of a note issued by their own diplomatic institutions stating that they will renounce their privileges and immunities while studying in China. After approval, the foreign affairs department shall send a letter of consent to the entry-exit administration department of the public security organ to change the "X" or "F" visa; those who come to China with foreign diplomacy, official or special passport exempted from visa according to bilateral agreements shall change their ordinary passport to the entry-exit administration department of the public security organ if they need to study or study in Institutions of higher learning. For "X" or "F" visas; for those who come to China with ordinary passport but not "X" or "F" visas, if they need to study or study in Institutions of higher learning, they should apply to the exit and entry administration departments of public security organs for the re-establishment of "X" or "F" visas. When accepting the applications of the above-mentioned persons, the entry and exit administration departments of foreign affairs and public security organs shall examine the applicant's Application Form for Visas for Overseas Students to China (JW201 or JW202), the School's Notice of Admission and the Record of Physical Examination of Foreigners.
Article 44 Family members of foreign students may apply to my embassy (consulate) for an "L" visa to accompany them in China on the basis of accepting the invitation letter from the school. By accepting official letters from the school, the entry-exit administration department of the public security organ extends the visa for the family members of foreign students accompanying them to study in China. The period of stay of the family members accompanying them in China shall not exceed the validity period of the residence permit of foreign students.
Article 45 Foreign students who have studied in China for more than six months must go to the health and quarantine department for the confirmation of the Records of Physical Examination of Foreigners within the prescribed time limit. Those who are unable to provide the Record of Physical Examination of Foreigners must undergo physical examination in the local health and quarantine department. Those who are confirmed to suffer from illnesses that are not permitted to enter the country according to the law of our country shall leave the country immediately and return home.
Article 46 Foreign students who enter the country with an "X" visa must apply to the entry and exit administration department of the local public security organ for a "Alien Residence Certificate" within 30 days from the date of entry. During the period of study, if there is any change in the items filled in the residence permit, the change formalities must be handled within ten days at the entry-exit administration department of the local public security organ.
Article 47 When a foreign student transfers to another city, he or she shall first go through the immigration formalities in the entry-exit administration department of the public security organ in his or her place of residence. After arriving at the place of immigration, the immigration formalities must be handled within ten days by the entry-exit administrative department of the public security organ in the place of immigration.
Article 48 Foreign students who leave the country temporarily during school must go through re-entry formalities before leaving the country. If a visa or residence permit still needs to study or stay in China after its expiry date, the extension formalities must be completed before the expiry date of the visa or residence permit.
Article 49 Foreign students must leave the country within the prescribed time after graduation, completion, completion or withdrawal. For foreign students who have been ordered to drop out of school or expelled from school, the school shall promptly notify the entry and exit administration department of the public security organ. The entry-exit administrative departments of public security organs shall collect their aliens'residence permits or shorten their stay in China according to law.
Chapter IX Supplementary Provisions
Article 50 The Ministry of Education shall be responsible for examining and approving the acceptance of foreign students by educational institutions other than general institutions of higher learning that implement full-time higher education for academic qualifications, and the relevant administrative measures shall be formulated separately.
